Terms and Conditions
of membership of the
Chocolate Fountain Association

The aim of the Association is to provide to its members and the clients members serve, a common set of industry standards, a level playing field of given safeguards.

To promote the highest standards of workmanship and services for and to a client, application for membership will be dependent upon the prospective member meeting the following requirements:

 

1. Receipt of satisfactory references from recent clients testifying to high standards of work.

2. Prospective members must sign an undertaking to abide by the rules, regulations and conditions as well as the aims of the Chocolate Fountain Association.

3. Membership is neither transferable nor retrospective. Where membership has lapsed, a new application must be made together with the requisite references before acceptance back into the Association.

4. Any misrepresentation, false statements or deception given on the application will lead to instant rejection without recourse.

5. Any misuse of the Association logo or claims of membership before acceptance will result in the applicant being rejected.

 

CODE OF PRACTICE

All Chocolate Fountain members must meet the following requirements:

1. All members will deal and handle clients in an ethical manner that will not bring the Chocolate Fountain Association into disrepute.

2. All Chocolate Fountain work carried out for a client must follow Legal , health and hygiene and safety guidelines as laid down by Government.

3. All complaints brought to the attention of the Association and then passed on to the Chocolate Fountain member must be dealt with speedily and satisfactory. When the Association writes to a member, the member is obliged to reply in writing without delay. Failure to follow this procedure will constitute a ligitimate reason for expulsion from the Association. Notice of expulsion will be posted on the Associaiton website.

4. All Chocolate Fountain members accepted to the Association should be aware of their legal obligations with regard to Sale of Goods Act, the Supply of Goods and Services Act and the Trades Description Act.

5. Members shall provide their membership number to members of the general public when requested to do so.

6. If for any reason an Association member must sub-contract part or all of an event or function to a sub-contractor, the subcontractor must be made aware of your signed responsibilities and must not bring into disrepute The Chocolate Fountain Association. Any or all complaints against a sub-contractor employed on your behalf will be judged as yourself and any disciplinary action will be made upon yourself as member of the Association.

7. All members will outline services and facilities offered to a client; preferably in writing as well as any variation in the quotation or services offered.

8. All members should have fully paid-up public and employee (if applicable) liability insurance cover. A Photo-copy must be lodged with the Association each year upon renewal of the certificate.

9. All members will have at the very least, the Basic Foundation Hygiene Certificate. A photo-copy of this must be lodged with the Association. Upon expiration, the new certificate must be lodged with the Association.

10. All written quotations and invoices must bear the VAT number and all prices must indicate whether VAT is inclusive, if a company is VAT registered.

11. All invoices must be uniquely numbered.

12. Once membership to the Association has ceased, the member shall not be entitled to display the Chocolate Foiuntain Association logo on their paperwork, website or advertising in the widest sense of the meaning.

13. The Chocolate Fountain Association reserves the right to expel members when their behaviour and/or workmanship are deemed to have fallen below standard required by the aims and objections and Terms and Conditions of the Chocolate Fountain Association.

14. Each member shall have the right of appeal to any decision made by the Chocolate Fountain Association against a member. Evidence must be produced in writing to back-up a member's statement.

 

SUBSCRIPTIONS

1. Each year's membership will be regarded as a separate contract and renewal will not be automatic.

2. The Association may ask for new references.

3. The Chocolate Fountain Association may change the annual subsciption fee for members at anytime.

4. ONLY the name of the company on the registration form will be registered with the Chocolate Fountain Association.

All members of The Chocolate Fountain Association are independent contractors. The Chocolate Fountain Association and its associated companies accepts no liability, whether in contract, tort or otherwise, for any loss, damage of whatsoever nature and whether casued by any breach of contract, negtligence or otherwise, on the part of any Member of the Chocolate Fountain Association, or by itself or any of it's officers, employees or agents.
